1.1 About Desify
Desify is an online community platform operating across Australia that provides three core services:- Listings – A space for users to post and browse classified adverts
- Events – Free and paid events that can be created, discovered, and attended
- Threads – Community discussions where members can share ideas and connect
For the purposes of these Terms and Conditions, "Desify", "we", "our", or "us" refers to NEXO GROUP PTY LTD (ABN 90 649 898 993), the operator of this platform.
1.2 Acceptance of Terms
By creating an account, accessing, or using Desify, you agree to comply with these Terms and Conditions and our Privacy Policy. During registration, you will be required to explicitly agree to these terms by selecting the consent checkbox before completing sign-up.You may not use the platform if you do not accept these Terms. You are responsible for ensuring that you have the authority to agree to these Terms, and users under the age of 18 must have parental or guardian consent to use the platform.
1.3 Changes to Terms
We may update these Terms and Conditions from time to time to reflect changes to our services, operations, or legal obligations. When changes are made, we will update the “Last Updated” date on this page. It is your responsibility to review these Terms periodically to stay informed of any updates. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.2. User Information and Privacy
2.1 Information We Collect
When you register for an account, we collect information such as your name, email address, and suburb. You may also be asked to specify your state or region within Australia so we can personalise your experience and deliver relevant local listings and events.2.2 How We Use Your Information
We use this information to create and manage your account, enable features such as listings, events, and threads, and deliver content relevant to your location.2.3 Data Protection and Breach Notification
We take reasonable steps to protect your personal information from misuse, loss, or unauthorised access. In the event of a data breach that is likely to result in serious harm, we will take appropriate steps as required by law, which may include notifying affected users.2.4 Privacy Policy
For more detailed information about how we collect, store, and use your personal data, please refer to our Privacy Policy. By using Desify, you agree to our Privacy Policy in addition to these Terms and Conditions.3. Listings (Adverts)
3.1 Creating and Publishing Listings
Users can create and publish adverts on Desify free of charge unless otherwise stated. Adverts must comply with all applicable laws and our content guidelines. We reserve the right to reject or remove any advert that is illegal, offensive, misleading, or otherwise violates these Terms.3.2 Expiry and Renewal Policy
Adverts are active for 90 days from the date of creation. Users will be notified before their advert expires and may choose to renew it. Renewal will extend the advert for an additional 90 days from the renewal date. Adverts not renewed within the allowed timeframe may be automatically removed.3.3 Moderation and Removal Rights
Desify reserves the right to remove any advert at our discretion, including but not limited to cases where the advert has been reported as abusive, fraudulent, or violates these Terms. We may also remove adverts for operational or technical reasons to maintain platform quality.3.4 Data Deletion Upon Removal
Adverts may be deleted by the user at any time or automatically when they expire. When an advert is deleted (by the user or by Desify):- The advert and its details are permanently removed
- Associated images are deleted
- All related messages and conversations are deleted
- The advert is removed from all user wishlists
Deletion is permanent and cannot be undone.
4. Events
4.1 Free / RSVP Events
4.1.1 Event Creation
Users can create Free/RSVP events on Desify. Event organisers are responsible for ensuring the accuracy of event details and compliance with all relevant laws. Desify does not host or run the event and is not responsible for its delivery.4.1.2 Email Notifications
Desify may send email notifications related to Free/RSVP events, including but not limited to:- Confirmation of event creation
- Registration confirmations and cancellations
- Updates to critical event details
- Notifications of event deletion
These notifications are intended to keep organisers and attendees informed about the status of the event.
4.1.3 Event Expiry
- Single Events expire automatically 5 days after the event date - Recurring Events expire 5 days after the last event in the series - Once expired, events are marked as “expired” and remain visible but cannot accept new registrations4.1.4 Recurring Events
Recurring events consist of a parent event and one or more child events. When the parent event is deleted, all child events are automatically deleted.4.1.5 Moderation and Removal Rights
Desify administrators or moderators may remove events that are reported for abuse, scams, illegal content, or other violations of these Terms. We may also remove events for operational or technical reasons to maintain platform quality.4.1.6 Event Deletion
Organisers may delete their Free/RSVP events at any time. When a Free/RSVP event is deleted (by the organiser or Desify):- The event details and images are permanently removed
- All registrations are deleted
- All related chat messages and conversations are deleted
- The event is removed from all user wishlists
Deletion is permanent and cannot be undone.
4.2 Paid Events
4.2.1 Event Creation and Expiry
Paid events follow the same creation process as Free/RSVP events. They expire 5 days after the event date, and once expired, are marked as “expired” and remain visible for reference but no longer accept ticket sales.4.2.2 Notifications
Paid events follow the same notification flow as Free/RSVP events, including event creation, registration confirmation, cancellations, updates, and deletion notices.4.2.3 Event Deletion
Paid events may be removed after consultation with the organiser. When a paid event is deleted: - The event details and images are permanently removed - Messages and conversations are deleted - The event is removed from wishlists - Financial records (tickets, invoices) are retained for at least 2 years for compliance and accounting purposes4.2.4 Organiser Access
Organisers retain access to check-in data and ticketing records during the active period of the event and for a reasonable time after expiry for reconciliation.4.3 Financial Terms for Paid Events
4.3.1 Platform Fees
A platform fee is applied to each ticket sale and is automatically deducted before payouts. Platform fees are non-refundable, even if the event is cancelled.4.3.2 Stripe Onboarding
All organisers must create and maintain a Stripe Standard Connected Account to receive payouts. By onboarding to Stripe, organisers agree to Stripe’s [Terms of Service](https://stripe.com/au/legal).4.3.3 Payout Timing
- The first payout is subject to Stripe’s initial holding period (typically 7–14 days after the first successful payment). - Ongoing payouts are made on a rolling 7-day schedule unless Stripe specifies otherwise. - Desify has no control over Stripe’s payout timing or delays.4.3.4 Compliance Holds
Stripe may delay payouts or adjust schedules if there are suspected fraud issues, disputes, or compliance checks. Desify is not responsible for delays caused by Stripe.4.4 Desify’s Role and Disclaimer
Desify provides the platform for event discovery, registration, and ticketing. Desify is not responsible for:- The organisation, hosting, or delivery of events
- The quality or outcome of any event
- Refunds, cancellations, or disputes between organisers and attendees
- Accidents, injuries, lost property, or other incidents at an event
All event-related disputes must be resolved directly between the organiser and attendees.
5. Threads
5.1 Creating Threads
Users can create discussion threads on Desify to share ideas, ask questions, or start conversations. Thread creators are responsible for ensuring that their content complies with all applicable laws and Desify's community guidelines. Desify does not endorse or verify the accuracy of user-generated thread content.5.2 Moderation and Community Guidelines
When participating in Threads, users must follow basic community standards, including:- Be respectful to other members
- Avoid hate speech, harassment, and abusive language
- Do not post illegal, defamatory, or infringing content
- Stay on-topic and avoid spamming
- Do not impersonate others or share misleading information
Desify administrators and moderators may remove threads, comments, or users that violate these guidelines or these Terms, at their discretion.
5.3 Thread Deletion and Data Removal
Threads may be deleted by the user at any time. When a thread is deleted (by the user or by Desify):- The thread and its content are permanently removed
- Any images attached to the thread are deleted
- All related chat messages and conversations are deleted
- The thread is removed from all user wishlists or saved lists
Deletion is permanent and cannot be undone.
6. Platform Availability and Issues
6.1 Uptime Commitment
Desify endeavours to keep the platform available and functioning at all times. However, we do not guarantee uninterrupted access and the platform may occasionally be unavailable due to maintenance, updates, technical issues, or circumstances beyond our control.6.2 Security and Safety
We take reasonable steps to maintain the security and safety of the platform, including data protection, privacy measures, and content moderation practices. Despite these efforts, no system is completely secure and users acknowledge that they use the platform at their own risk.6.3 Issue Resolution and Limitations
If a technical issue arises, we will make reasonable efforts to resolve it as quickly as possible. Desify is not liable for any loss, damage, or inconvenience caused by downtime, service interruptions, security incidents, or other issues beyond our reasonable control.7. Banner Advertising
7.1 Payment Terms
Banner advertising campaigns must be fully paid in advance, as agreed between Desify and the advertiser, before the campaign can commence.7.2 Refund Policy
Payments for banner advertising are generally non-refundable. In the event of a service interruption caused by Desify’s systems:- Short Outages (under 24 hours): Campaigns may be extended to compensate for lost time but no cash refund will be provided.
- Extended Outages (over 24 hours): A pro-rata credit or extension will be offered for the remaining duration of the campaign.
Refunds or credits are not provided for outages caused by factors outside Desify’s control, such as third-party hosting issues, internet disruptions, or user device/browser errors.
7.3 Service Outages and Limitations
While Desify endeavours to keep banner ads running continuously, we cannot guarantee uninterrupted ad delivery. Desify is not responsible for failures due to: - Internet or power outages - CDN or upstream provider downtime - User-side issues preventing ad displayOur responsibility is limited to making reasonable efforts to restore service and, where applicable, applying campaign extensions or credits as outlined in Section 7.2.
8. Communications
8.1 Transactional Emails
By registering on Desify, you agree to receive transactional and service-related emails that are necessary for the operation of your account. These may include:- Account creation confirmations
- Password resets and security alerts
- Notifications related to your listings, events, or threads
- Legal or policy updates
These communications are considered essential to using the platform and cannot be opted out of while your account remains active.
8.2 Marketing Emails and Offers
During registration, you may choose to opt in to receive promotional emails, updates, and offers from Desify. If you opt in, you can withdraw your consent at any time by using the unsubscribe link provided in our marketing emails or by updating your account settings.Marketing communications are separate from transactional emails and opting out will not affect essential service-related communications.
9. Copyright and Intellectual Property
9.1 User Responsibility for Content
Users are solely responsible for any content they upload, post, or share on Desify, including text, images, and other media. By posting content, you confirm that you own the rights to it or have permission to use it. You grant Desify a non-exclusive, worldwide, royalty-free license to display and distribute your content for the purposes of operating the platform.9.2 Reporting Infringements
If you believe that any content on Desify infringes your copyright or other intellectual property rights, you may report it by contacting us through our support page. Please include sufficient information for us to identify the content and verify your claim.9.3 Removal Process
Upon receiving a valid infringement report, Desify will review the claim and, where appropriate, remove or disable access to the allegedly infringing content. Repeat infringers may have their accounts suspended or terminated at our discretion.10. Legal Entity and Governing Law
Desify is a trading name of NEXO GROUP PTY LTD (ABN 90 649 898 993), an Australian Private Company. All references to "we", "our", or "us" in these Terms and Conditions refer to NEXO GROUP PTY LTD.
These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. By using the platform, you agree that any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Western Australia.
